1.       International students who are holding a valid student visa in Australia on 8/2/2010 and is qualify for transitional arrangement can on or until 31/12/2012 apply for Skilled-Graduate Temporary Visa with occupation on Skilled Occupation List (SOL)  http://www.immi.gov.au/skilled/general-skilled-migration/transitional/_pdf/sol-twoabc.pdf

2.       Skilled-Graduate Temporary Visa holder or applicant who qualify for transitional arrangement can on or until 31/12/2012 apply for Subclass 885, 886 or 487 visa with nominated occupation as in Skilled Occupation List (SOL) http://www.immi.gov.au/skilled/general-skilled-migration/transitional/_pdf/sol-twoabc.pdf

3.      Interdependent (same sex) partner can be included in the application.

2. Skilled migration visa.

2.1. Application with Australia Qualifications

-      After you have graduated from your course of study in Australia and if you wish to seek permanent residence in Australia, we are able to assist you to lodge the appropriate migration application for you. However, please note your qualification must meet the migration criteria at the time of your application.

Generally, you must study at least 2 academic years or 4 semesters for your Trade Certificate, Diploma or degree programs in Australia. You must also nominate your occupation (http://www.immi.gov.au/skilled/_pdf/sol-schedule1.pdf or http://www.immi.gov.au/skilled/_pdf/sol-schedule1-2.pdf ) which is relevant to your qualification. You must also provide IELTS certificate as evidence of your English language proficiency skills and you must under the age of 49. 

2.2.  Application with Overseas Qualifications

-      Alternatively, if you have an overseas qualification as well as relevant working experience in an occupation, which is in demand in Australia, and you are able to meet the other migration criteria for this class of visa, such as age factor, language skills as well as sponsorship if also available (but not necessary), we are able to assist you in your skilled migration application as well.

If your occupation is on the list above, you may qualify for skilled migration to Australia.  Please kindly contact us to find out on whether with your nominated occupation, whether you are also likely to meet the skilled migration criteria. 

 

 

3. Business visa.

New requirement as from 19th April 2010:

3.1. Investment (Provisional Visa)

You can consider applying for State/territory government sponsored Investor Visa (Provisional) for migration to Australia if:

 

- If you plan to invest A$750,000 in a designed investment in Australia.

- If you have at least 3 years of successful managing an investment or business.

- You and your spouse together have own 10% of the total value of the business or A$750,000 of the investment you are managing,

- You and your spouse together have accumulated business and personal assets of at least A$1,125,000 which are legally owned.

- You are less than 55 years old.

- Or if you are over 55 years old, your proposed business or investment has exceptional economic benefit to the state you plan to migrate.

- You and your spouse do not have history of involvement in unacceptable business activities

- You have genuine and realistic commitment to continue to maintain business or investment activity in Australia after designed investment has matured.

3.2. Establishing Business or Business Owner (Provisional Visa)

You can consider applying for State/territory government sponsored Business Owner Visa (Provisional) for migration to Australia if :

 

Have a successful business career.

- Your main business has business turnover of at least A$300,000 in at least 2 of the 4 latest financial years.

- Your business ownership is:

a.  51% if business turnover is less than A$400,000 per year or

b.  30% if business turnover is A$400,000 or more per year or

c.  10% of a public listed company

- You and your spouse has legally owned capital of at least A$500,000 for transfer within 2 years to Australia to establish business in Australia.

- You have additional funds for settlement in Australia.

Or if you are over 55 years old, your proposed business or investment has exceptional economic benefit to the state you plan to migrate

- You have realistic commitment to establish or participate and maintain a substantial ownership interest in a business in Australia

- You maintain direct and continuous involvement in management of the business which benefits the Australian economy.

3.2.1. Business Talent (Permanent Visa)

You can consider applying for Business talent Visa (Permanent Visa) for migration to Australia if :

 

- You are less than 55 Years old.

- Or if you are over 55 years old, your proposed business or investment has exceptional economic benefit to the state you plan to migrate

- You have a successful business career.

- You and your spouse together in at least 2 of the 4 financial years has a qualifying business ownership interest of at least AUD$400,000.

- Or 10% of shareholding in a public listed company.

- The main business turnover in at least 2 of the 4 financial years of at least A$3,000,000.

- You and your spouse together have legally owned business and personal assets of at least A$1,500,000.

- You have realistic commitment to establish or participate and maintain a substantial ownership interest in a business in Australia

- You maintain direct and continuous involvement in management of the business which benefits the Australian economy.

3.3. Senior Executive (Provisional)

You can consider applying for senior executive or state/territory government sponsored senior executive visa for migration to Australia if:

-          Aged is less than 55 years old

-          You are one of the top 3 positions in management structure in a major business with annual turnover of at least A$10,000,000 (10 million)

-          You are responsible for strategic policy development affecting a major component or a wide range of operations of that major business. 

-          Between you and your spouse have business and personal assets total A$500,000 which is able to transfer to Australia to conduct or establishment of a business in Australia within 2 years after the grant of the visa.

-          You and your family also have other personal assets to settle in Australia.  

-          After the grant of visa, you have genuine and realistic commitment to establish or participate in a qualifying business in the regional with exceptional economic benefit to the state or Territory in Australia,

-          And you continue to maintain substantial ownership in that business.

-          You do not have history of involvement in unacceptable business activities.

4. Family visas

4.1. Partner Visa

If you have been genuinely and legally married to an Australian or Permanent resident of Australia or alternatively, living in a de facto relationship for 12 months (or less than 12 months if there are compelling and compassionate circumstances) with an Australian or Permanent resident of Australia and there is a need for you to be united with your spouse to settle in Australia and your spouse is also legally able to sponsor you in your partner visa application, we can assist you in your partner visa application.

Generally, the partner visa granted to you include a 2 years temporary partner visa and follow by permanent resident partner visa at the end of the 2 years temporary partner visa.  To be granted a permanent resident partner visa, you must be able to prove that the relationship is still genuine and continuing and your Australian spouse is continuing to sponsor you in the application.

4.2. Prospective Marriage (Fiancé or Fiancée) Visa

If you have genuinely and legally engaged to an Australian or permanent resident of Australia, we can assist you to apply for this class of if both you and your Fiancé’/e in Australia are genuinely planning and legally able to get marry in Australia within 9 months of your arrival in Australia while holding this class of visa.  You must also ensure that your Fiancé’ /e in Australia is legally able to sponsor you in the application.

4.3. Parent Visa

If the number of your children who settled in Australia is equal or larger than the number of your children who live in your own country or overseas countries and your one of your children who settled in Australia is willing to sponsor you to apply for parent visa. It is possible for you to apply for a parent visa to settle in Australia.

Generally, you can apply for this type of visa while you are in your own country.  Or alternatively, if you have reached the retirement age of Australia (Male 65 years old and female 62.5 years old and above), and you have a valid visa in Australia which allow you to apply for this type of visa in Australia, you may be able to lodge your application in Australia and wait for the outcomes of the application while you are in Australia.

If you do not have large capital, it is possible for you to apply for a type of parent visa which pay only one application fee.  However, the disadvantage in applying this type of parent visa is because of the limited quota, you will have to prepare to wait for many years before your application is finalised.

Alternatively, you may choose to apply for a “fee paying” parent visa.  Under this type of visa, because there is a larger number of quota, you would expect that you application would be finalised in shorter time.  Generally, there are 3 lots of fees involved in the application.  These are:

1.    Initial application fee – Charge per application whether the application is one person or 2 persons.

2.    Financial assurance of support - Main applicant is A$10,000 and spouse is A$4000; this financial assurance of support is arranged through your financial assurer and the undertaking is last for 10 years. The fund is refundable to the financial assurer after 10 years.      

3.    Third payment is currently at A$40,015 per person*

The advantages of applying “fee Paying” Parent Visa are:

1.    Shorter waiting time to your application finalised.

2.    You are entitled to enjoy the benefit of Australia medicare cover as soon as you in Australia. 

4.4. Child Visa

You can apply for a permanent child visa to settle in Australia if your parent is an Australian, Australia permanent resident or eligible New Zealand Citizen who are able to sponsor you in the application and you are either:

1.    Under 18 years old and single or

2.    if you are 18 or over but less than 25, you (a) have never married, in a de facto relationship or engaged to be married, (b) you have been a full-time student since turning 18 years old and doing a post secondary professional, trade or vocational program and doing the program within 6 months of completion of secondary studies (c) You have never in full-time employment.
